NEW DELHI: The Supreme Court on Monday ordered the UP federal government to choose within three months launching over 2,200 lifers, lodged in numerous prisons in the state, by giving remission of staying sentences as they have gone through more than 14 years of incarceration.A bench of CJI DY Chandrachud and Justices PS Narasimha and JB Pardiwala noticed that the policy of the state prior to 2018 provided that a lifer would be eligible for grant of remission of remaining part of his life term when he serves 14 years of real imprisonment.Amicus curiae Rishi Malhotra mentioned that countless lifers are suffering despite the fact that they were eligible for grant of remission as many of them do not have the resources or awareness to move a remission application.He said even after the SC ruled that the state is bound to consider remission of sentence of eligible lifers without the individual submitting an application, the execution on the ground is slack.

This is resulting in scores of petitions for grant of remission being submitted in the Allahabad HC and SC.UP government standing counsel Ardhendumauli Prasad mentioned the affidavit filed by the DG jails and stated of the 16,262 life convicts lodged in numerous prisons in the state, 2,228 have served over 14 years in prison and are eligible for remission.

Their cases are pending consideration at different phases before the suitable committee, which would send its recommendation to the state and after that for final decision by the guv, he said.The bench said, The Supreme Court has time and once again directed, as a general concept, that the policy operating on the date of conviction of the individual, will govern his plea for premature release which he would be entitled to benefits if a more liberalised policy is promulgated later by the state .

The SC also stated it would institutionalise the structure for grant of remission across the nation and chose to use up for examination the circumstance of lifers and grant of remission treatments in Maharashtra, Bihar, Madhya Pradesh and Rajasthan on the next date of hearing.
